Official Rules

NO PURCHASE REQUIRED, OPEN TO FEMALE RESIDENTS OF THE UNITED STATES WHO ARE 18 YEARS OR OLDER. VOID WHERE PROHIBITED OR OTHERWISE RESTRICTED BY LAW.

COMPETITION ENTITIES
Tip The Hottie, LLC (the "Competition Entity") is the sponsor of the TIPTHEHOTTIE.COM Hottie of the Month competition (the "Competition").

HOW TO ENTER
To enter, follow the links at www.tipthehottie.com (the "Web Site") to the official entry form. You must provide all information requested and will be able to upload five (5) recent and different photographs of yourself in JPEG format, (the "Submitted Photographs") using the instructions provided. Only the Entrant (defined below) should appear in the Submitted Photographs. All photos must be no larger than 1 MB in size. Please be sure to retain the original photographs, as the Winner may be required to submit the Submitted Photographs in greater resolution. After completing the entry form, a confirming email will be sent to the email address that you provide.  You must click on the link provided in that email, which will take you to a page of the Web Site where you will verify your entry.

The Competition Entities reserve the right to contact a person who has entered the Competition (an "Entrant") to request resubmission of one or more of the Submitted Photographs and/or to request that the Entrant submit additional photos, in Competition Entities' sole discretion, if there are problems with the Entrant's initial submission of such Submitted Photographs, or if there are other questions or problems with such entry. While Entrants may have assistance in entering data and uploading the photos, each Entrant must otherwise complete the entry forms herself. Any entries submitted by anyone other than the person appearing in the Submitted Photographs (including but not limited to entries submitted by modeling agencies) will be rejected. As set forth in greater detail below, submission of photographs and entry in the Competition constitutes consent to use the Submitted Photographs on the Web Site, and/or associated or otherwise affiliated Web sites; as well as Entrant’s representation that she owns or controls sufficient rights in the Submitted Photographs to grant the Competition Entities the rights described herein.

Any Submitted Photographs exhibiting Entrant's nipples or genitals will be rejected. The determination of whether any image exhibits Entrant's nipples or genitals is in the sole discretion of the Competition Entities. False, deceptive or incomplete entries or other information provided by Entrants throughout the Competition (including but not limited to responses to questionnaires) shall render the entry ineligible.

ELIGIBILITY
All Entrants must be legal residents of any state of the United States, must be female, and must have been 18 years of age or older on the date that the earliest of the Submitted Photographs was taken. The Competition Entities reserve the right to disqualify any Entrant whose image has been published, or during the course of this Competition is published, in any media (publications, World Wide Web, television, etc.), in a manner that is considered by the Competition Entities, in their sole discretion, to be pornographic, vulgar or obscene. All Entrants who are selected as the Winner further agree that for the one (1) month period following the announcement of the Winner, their images shall not be published in any media (publications, World Wide Web, television, etc.), in a manner that is considered to be pornographic, vulgar or obscene by the Competition Entities, in their sole discretion.

Failure to comply with these Official Rules will result in ineligibility of Entrant. Entrant appoints Competition Entities as her attorneys in fact, and grants Competition Entities permission to demand the removal of any photographs that violate these Official Rules. Employees, representatives and agents of the Competition Entities, their parent companies, subsidiaries, affiliates, and their advertising and production companies and any family member or person domiciled with any of the foregoing, are not eligible to participate. All federal, state/provincial and local laws and regulations of the United States apply. Void where prohibited or restricted. Entrants agree to be bound by these Official Rules.

SELECTION OF A WINNER
One or more photos of each Entrant will appear on the Web Site, or an affiliated or associated Web site, or in or on any publication, product or item owned or otherwise affiliated with the Competition Entities. During the current month, participating visitors, will have the opportunity to tip their favorite Entrant. The Competition Entities, in their sole discretion, will choose a Winner, based upon the result of the voting (20%), and the Competition Entities' evaluation of the Entrant's attractiveness and photogenic qualities (40%) and quality of the photographs from the Entrant's submitted photographs (40%). In the event that a Winner is determined to be ineligible or withdraws from the Competition, the Competition Entities reserve the right to select another Winner.

WINNER’S PRIZE
The Winner will be awarded $200.00 USD one (1) month following the announcement of the Winner. Winner may refer to herself as a "TIPTHEHOTTIE.COM Hottie of the Month" in written and descriptive materials such as a biography, résumé, or other purely noncommercial descriptive aspect. The Winner may use the TIPTHEHOTTIE.COM logo (copy to be provided upon request of the Winner) in connection with Winner's portfolio and personal promotional online site only, provided that the logo may only be used in connection with the Licensed Photograph, and further provided that such online site does not include any photos that are considered pornographic, vulgar or obscene (which is to be determined in the sole discretion of Competition Entities).

All federal, state/provincial and local laws and regulations apply. Taxes, if any, are the winner's sole responsibility. No substitution, transfer, assignment or cash equivalent permitted. The Competition Entities reserve the right to substitute prizes with one of equal or greater value, at the Competition Entities' sole discretion.

NOTIFICATION/TERMS
Selected Winners will be notified by email, telephone or other means reasonably calculated to provide notice. Entry constitutes permission to use Entrant's name on the Web Site, or an affiliated or associated Web site, and their consent to use her name, photograph (including Submitted Photograph and Additional Photographs), comments and likenesses for advertising or publicity purposes, in any and all media - including but not limited to magazines, online display, television, cable, video, DVD and/or film productions, wireless applications and other media channels and applications, and for advertising, promotions, other competitions sponsored by one or all of the Competition Entities and other commercial purposes (whether by the Competition Entities or any third party, including but not limited to beer or liquor companies) - without additional compensation or permission, except where prohibited by law.  Entry also constitutes a representation that Entrant owns sufficient rights in all images to grant Competition Entities the right to use such images as contemplated by these Rules and, in particular, that Entrant either personally owns the copyright to the Submitted Photographs and Additional Photographs, or that the respective copyright holders have granted Entrant the right to allow the Competition Entities to reproduce the Submitted Photographs and Additional Photographs, and to publish the Submitted Photographs and Additional Photographs as set forth in these Official Rules and/or herein.  Entrant is responsible for any financial reimbursement to the original Copyright Holder for the rights to publish the Submitted Photographs and Additional Photographs; the Competition Entities will not be responsible for any such payment.  Entrants hold the Competition Entities harmless and to indemnify the Competition Entities from any and all liabilities, loss, claims, or causes of actions, including reasonable attorneys’ fees and expenses that may be incurred by the Competition Entities, arising out of or relating to my breach of any of the foregoing representations and warranties.

Entrants do not have the right to license Competition Entities' name or trademarks, including but not limited to "TIP THE HOTTIE" to any other entity, even if Entrant is making an appearance on behalf of that entity. Any such license must be secured from Competition Entities. Any use of "TIP THE HOTTIE," or any reference thereto, in connection with any promotional event or advertising must first be approved by the Competition Entities in writing.

Winners must agree to participate in a photo shoot on behalf of Competition Entities or a third-party advertiser to be selected in the sole discretion of Competition Entities, to participate in promotional events on behalf of advertisers selected at the sole discretion of Competition Entities, and to host one or more parties on behalf of the Competition Entities and/or advertisers , all without additional compensation (except that transportation and hotel accommodations may be provided at the sole discretion of Competition Entities). Winner must agree to appear on a downloadable wallpaper to be included on the Á La Carte page on the Web site, and is aware that such wallpaper may be sponsored by one or more of the Competition Entities' advertisers.

Entrants consent to a background check that may be performed, at the sole discretion of the Competition Entities, to verify information provided by Entrants and compliance with these Official Rules, or for other reasons related to the Competition. This Competition shall be governed and construed by Michigan law, and the exclusive venue for all controversies will be in state or federal court in Michigan. All federal, state/provincial and local taxes are the exclusive responsibility of the Winner. Competition Entities reserve the right to crop or otherwise alter photographs. Entrant waives (or shall ensure that copyright holder waives if Entrant is not copyright holder) in favor of Competition Entities and anyone authorized by them, any and all moral rights that Entrant (or copyright holder) may have in any photograph submitted. If any Entrant does not return any document within the timeframe indicated on the document, or cannot be contacted, Entrant will be disqualified.

DISCLAIMER AND RELEASE OF LIABILITY
The Competition Entities and all prize providers are not responsible for any incorrect or inaccurate entry information, human error, technical malfunction, failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, access providers, or software, including any injury or damage to participants' or any other persons', computer relating to or resulting from participation in this Competition; inability to access the Entry Web site or any pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entry submissions that are processed late or incorrectly or are incomplete, garbled, or lost due to computer or electronic malfunction or traffic congestion on the Internet or any Web site. Proof of entering information at Web Site is not considered proof of delivery or receipt. All dates set forth in these Official Rules are approximate. Competition Entities reserve the right to extend any deadlines. All entries any other materials submitted (including but not limited to photographs) become the sole property of the Competition Entities and will not be returned or acknowledged. False and or deceptive entries or accounts shall render entry ineligible.

All decisions of the Competition Entities shall be final and conclusive on all matters relating to the Competition.

All Entrants, and Winners release the Competition Entities and their parent companies, affiliates, subsidiaries, wholesalers, retailers, officers, directors, agents, employees and all others associated with the development and execution of this Competition from any and all liability with respect to, or in any way arising from, this Competition, publication or use of their photographs, and/or acceptance or use of the prizes, including liability for personal injury, death, damages, or monetary loss.

The chances of becoming a Winner of the Competition depend on the number of entrants, on the judging criteria, and how well the entrant rates on each such criterion compared to other entrants.

The Competition Entities reserve the right to terminate, withdraw or amend the Competition for any reason.

Entrants consent to the Competition Entities' collection, use and disclosure to third parties of Entrants' personal information for the purpose of administering this Competition and as otherwise set out in these Official Rules.
